

TERMS, CONDITIONS & SAFETY
At Mal's BBQ Boats we take safety seriously because we know that a great holiday is a safe holiday. This is why when you book with Mal's BBQ Boats you can rest assured that we will provide you with all of the necessary safety equipment, including life jackets, before you set out on your adventure.

Before departing you will also complete a comprehensive safety induction to prepare you.
Terms & Conditions
​
All participants are required to read and agree to the following Terms & Conditions as part of the on-site induction prior to departure.

1. Safety Induction
Before departure, all guests must participate in a mandatory safety demonstration, which will include instruction on the following:

Emergency contact phone numbers

Starting and stopping the outboard motor
-
Operating the vessel in forward and reverse
-
Correct use of life jackets and when they are required
-
All children under 12 years of age must wear a life jacket at all times while the vessel is in motion
-

Location of fire extinguisher and first aid kits
-
Location of the life ring
-
Location and use of the inlet map, including:
-
Public moorings
-
Approved access areas
-
Restricted and out-of-bounds areas
-

Areas the vessel must not enter, including:
-
Under the bridge
-
The main channel
-
-
Correct use of the onboard toilet
-
Location of rubbish bins
-
The inlet is a pristine waterway, and all guests are expected to help keep it clean
-

Anchor location, correct anchoring procedure, checking anchor rope, and safe storage of loose rope
-
Gate safety and explanation of why bow riding is strictly prohibited
-
General vessel operation and correct return of the vessel to the wharf
-
Respecting wildlife in and out of the water

2. Prohibited Activities
For safety reasons, the following activities are strictly prohibited at all times:

Accessing or standing on the roof of the vessel
-
Diving or jumping from the vessel
-
Bow riding
-
Landing the vessel on the foreshore
-
Entering oyster leases or sandbars
Failure to comply may result in immediate termination of the hire without refund.

3. Safe and Responsible Behaviour
All guests agree to behave in a safe and responsible manner at all times while in possession of the vessel.

The driver of the vessel must remain under a blood alcohol concentration (BAC) of 0.05 at all times while operating the vessel
-
Guests must follow all instructions provided by Mal’s BBQ Boats staff, whether written, verbal, or implied
-
The vessel must be operated in a safe and lawful manner at all times

4. Capacity & Responsibility

The maximum number of people permitted on board the vessel is 12
-
Exceeding this limit may result in fines issued by Maritime authorities
-
By agreeing to these Terms & Conditions, the designated responsible person accepts full responsibility for:

The safety and wellbeing of all passengers
-
The safe operation and security of the vessel
-

5. Condition of Vessel & Damage
The vessel must be returned in the same condition as it was at departure, allowing for normal wear and tear.

If the vessel is returned untidy or unclean, a $100 cleaning fee will apply
-
Guests are financially responsible for all damage, loss, or breakage incurred during the hire period

6. Acknowledgement of Responsibility
By agreeing to these Terms & Conditions, the designated responsible person acknowledges and agrees that:

They have undertaken the full safety induction
-
They understand and accept all safety requirements and operating instructions
-
They will remain sober and below a BAC of 0.05 while in control of the vessel
-
They will ensure the safety of all passengers at all times
-
They will operate the vessel responsibly and prioritise passenger safety

7. Cancellation & Bad Weather Policy

Cancellations or booking changes must be made at least 48 hours prior to the scheduled booking time
-
Mal’s BBQ Boats reserves the right to cancel or reschedule bookings due to poor or unsafe weather conditions

In the event of a weather-related cancellation by Mal’s BBQ Boats, customers will be offered:
-
A rescheduled booking, or
-
A credit or refund
-

All refunds are subject to a 5% administration and processing fee
